Since the Fourth World Conference on Women held in Peking 1995, domestic violence issues have been widely paid attentions to with the help of some scholars and non-governmental organizations. In 2001, “Domestic Violence” was for the first time enacted in the newly amended Marriage Law of the People's Republic of China. Accordingly, the Law of the People's Republic of China on the Protection of Rights and Interests of Women amended in 2005 and its measures for implementation formulated rules concerning domestic violence. In 2008, The Guide for Trials of Cases Concerning Domestic Violence was enacted by the Institute of Applied Jurisprudence of the Supreme Court of People’s Republic of China and implemented by over one hundred local courts. So far, Law for anti domestic violence has been put on the agenda of legislation. The achievement of work on anti domestic violence is remarkable. Nevertheless, we still have some problems to confront, for instance, to prove domestic violence is still difficult, policemen seldom register domestic violence between a couple as case, besides, the sentence granted to women murderers for the excuse of being treated violently is usually harsh and there are still other situations disadvantageous to women involved in domestic violence.
In recent years, several murders against husband for the excuse of domestic violence took place. Due to the absence of uniform anti domestic violence law, punishments granted in similar cases vary among different local courts from immediate execution to 3-year imprisonment with 5-year probation. Regardless of the different specific details and media spotlights, the difference is resulted from different perceptions of similar cases. In order to improve readers’ understanding of relevant cases, in three consecutive periodicals we will introduce three cases in consecutive represented by Qianqian Law Firm concerning murder against husband due to domestic violence and analyze the cases from perspective of law and society(The first).
